Budget 2012 - Employer Compliance Matters

DUTY TO FURNISH PARTICULARS OF PAYMENT MADE TO AN AGENT, ETC
A new Form CP58 has been prescribed for purposes of Section 83A ITA,
1967.  The deadline for providing the prescribed form to the agent,
dealer or distributor for payments made in the period 01/01/2011 to
31/12/2011  is not later than 31 May 2012. The penalty for
non-compliance ranges from RM200 to RM2,000.

For most of us,   whether in business or under employment, filing of tax
returns is a  big headache.    Appended herebelow are the  IRB's
deadlines for submission of tax returns by individuals and employers:-

New Double Taxation Agreement with Hong Kong

Malaysia signs a comprehensive double taxation agreement (DTA) with
Hong Kong on 25 April 2012.  The DTA will come into force after the
completion of ratification procedures by Malaysia and Hong Kong.

The DTA allocates taxing rights between Hong Kong and Malaysia and will
provide investors with greater certainty on their tax liabilities from
cross-border economic activities and boost closer economic and trade ties
between the 2 countries.  Under the DTA, the withholding tax (WHT) on
dividends, interest, royalties and technical fees is as follows:









Please note that Malaysia does not currently levy WHT on dividends.Click
